The West Virginia month to month lease allows a landlord (“lessor”) and tenant (“lessee”) to create a contract that permit the lessee to occupy a residential unit for thirty (30) days at a time. Payment by the tenant must be made on the specified date in the lease in order for the tenancy be extend for another monthly period.
Even though the agreement is for a short-term period, the same eviction process remains as if the term was for a standard one (1) year timeframe. Therefore it is recommended that the lessor protect themselves by thoroughly screening every tenant with the rental application to ensure the tenant’s employment and income can afford the rental payment.
- It is federal law that if the housing unit was built before 1978 that the landlord must obtain the lead based paint disclosure signed by the tenant. This is to notify the lessee(s) of the hazardous toxin on the premises and to warn of any chipping or peeling of paint.
