A Vermont residential lease agreement is a contract between a landlord and tenant that states the terms and conditions under which the lessee may occupy the rented property. The term is generally for one (1) year but can be altered if agreed upon by the parties. The tenant will usually be required to pay a small fee and undergo a credit check through the rental application to ensure that he or she is suitable for a lease.

Definition (9 V.S.A. § 4451(8)) – (8) “Rental agreement” means all agreements, written or oral, embodying terms and conditions concerning the use and occupancy of a dwelling unit and premises.

Security Deposit Laws

Maximum Amount – No statute. The landlord can charge as much as desired.

Returning – The landlord has 14 days to send the security deposit back to a tenant along with an itemized list of deductions (if any). For seasonal rentals, the landlord has 60 days to return any deposits made (9 V.S.A. § 4461(c)).

Required Disclosures

Lead-Based Paint Disclosure – Required by the EPA to disclose to tenants that lead paint has potentially been used on the property. Required for any structure built prior to January 1, 1980.

Rent Grace Period

Per Vermont law, there is no grace period.

“Rent is payable without demand or notice at the time and place agreed upon by the parties.”
