A Utah month-to-month rental agreement is used when two (2) parties (landlord and tenant) are held to the terms of an agreed contract for one (1) month at a time. When rent payment is due, usually at the first (1st) of the month, the contract renews for an additional term.

According to State law (§ 78B-6-802), the landlord must give the tenant at least fifteen (15) calendar days’ notice to vacate the premises if they wish to terminate the contract. If the tenant decides to stay beyond the fifteen days, the same eviction laws apply as if it were a standard lease agreement. Therefore it is highly recommended that the landlord screen each potential lessee with the rental application before authorizing any binding contracts.

Minimum Termination Notice

A month-to-month tenancy may be terminated by providing fifteen (15) days’ notice (§ 78B-6-802(1)(b)(i)).
