A Tennessee sublease agreement allows a current tenant to sublet their property to someone else. Subletting is the leasing of space by a person who is currently under a fixed agreement and wishes to act as a sublessor and lease a portion of the entire space to someone else (sublessee). Typically, a residential lease agreement forbids the act of any type of subletting on behalf of the tenant, so it may be necessary to get written approval before seeking out a subtenant.

When accepting a sublessee, it is a good idea to verify their income and employment status through the rental application, as the sublessor will be responsible for all rental payments, damage/repairs to the premises, and eviction/vacating at the appropriate time.

  • As per federal law, the sublessee must be presented with the lead-based paint disclosure if the housing unit was constructed before 1978.
