Otherwise known as a “Tenancy at Will”, allows for a landlord and tenant to come to terms on a short term arrangement for the occupying of residential property. The contract has no end date, and updates every month upon the payment of rent by the lessee. Although, the landlord may terminate the lease (See 66-28-512 of Residential Landlord and Tenant Act) with at least thirty (30) days notice to the tenant. The tenant may as well void the contract under the same terms and it is highly recommended for legal purposes that the written notice for termination be sent through certified mail.
The landlord should take the same caution when renting to a short term tenant as all eviction laws in the State apply. Therefore the landlord should require at least one month’s Security Deposit in addition to reviewing their income and employment through an application.
- The tenant must be given the lead based paint disclosure to sign and attach to the lease if the leased unit was built prior to 1978.
