Security Deposit Laws

Maximum Amount ($) – There is no restriction on the amount a landlord can charge.

Returning – Thirty (30) days (§ 27-40-410(a)). If the landlord does not pay on time, the tenant may be owed three (3) times the deposit amount plus attorney’s fees (§ 27-40-410(b)).

Required Disclosures

Owner/Landlord Information – Tenants must receive a disclosure informing them of the name and address of the owner, landlord, or another authorized individual. This disclosure is required for the delivery of legal notices and demands (§ 27-40-420(a)).

Lead-Based Paint Disclosure – If the space being rented was built before 1978, the lead-based paint disclosure form must accompany the rental agreement. It must be signed by the tenant to acknowledge the acceptance of the document.

Disclosure for Unequal Security Deposits – Landlords who A) rent more than four (4) adjoining units and B) enforce varying security deposit standards for each tenant must inform the tenants of the measures which determine how the deposit amounts are established. This information must be provided before entering into a rental agreement (§ 27-40-410(c)).

Rent Grace Period

South Carolina does not have a grace period for late rent. Rent payments are to be made on the date stated in the rental agreement (§ 27-40-310(c)).
