A Mississippi residential lease agreement is a standard one (1) year contract that binds the renter and landlord for the full extent of the term unless each mutually agrees to break the lease. The landlord is typically due rent on the first (1st) of every month and if the lessee moves in prior to the 1st, then the rent is usually pro-rated to reflect the terms. The landlord is advised to take the tenant’s credit information beforehand to make sure that he or she is able t pay the rental amount every month. Also, verifying with previous landlords and property managers will give the lessor a good idea if the potential tenant is someone worth a lease.

Security Deposit Laws

Maximum Amount ($) – There is no limit on the amount of money that a landlord can request tenants to pay for a security deposit.

Returning – The landlord has a maximum of forty-five (45) days from the termination date of the tenancy to return the tenant’s security deposit (§ 89-8-21).

Required Disclosures

Lead-Based Paint Disclosure – Landlords must inform tenants in writing of the presence of any lead-based paint that is common in buildings erected before 1978.

Rent Grace Period

No grace period. The landlord must state any financial penalties for late rent in the lease for them to be enforceable. If rent is unpaid, the tenant may be given three (3) days’ notice to pay or quit (§ 89-7-27).
