A Mississippi month-to-month lease agreement is a preferred tenant arrangement where the lessee can occupy the property by paying rent each month but is not liable for a fixed term. The contract under the terms allows for the landlord or the tenant to be able to modify the agreement with thirty (30) days of written notice to one another.

Other than the differences in the length of the agreement or tenancy, all State laws are still required to be followed by the landlord and tenant. In addition, the landlord should not take the tenant under a Tenancy at Will lightly as the same eviction rules must be followed, giving each tenant the same amount of legal liability as with a standard residential lease. All tenants should be reviewed closely through the rental application to ensure that all the criteria for a qualified lessee are met to reduce the chances of a possible eviction or non-payment of rent.

Minimum Termination Notice

A minimum of thirty (30) days’ notice must be given to terminate a month-to-month lease (§ 89-8-19(3)).
